# Terms of Service
These Terms of Service ("Terms") govern your use of stuffyourmomhates.com and any purchase you make from Stuff Your Mom Hates ("SYMH," "we," "us," "our"). By accessing the site, creating an account, placing an order, or otherwise using our services, you agree to these Terms. Please read them before using the site.
Some purchases are governed by additional terms set out below — in particular **Section 6 (Advance Orders)** and **Section 7 (New Comic Condition and Grading)**. Those sections apply in addition to the rest of these Terms.

## 1. Acceptance of Terms
By using our website or services, you agree to these Terms, to our Privacy Policy, Shipping Policy, and Return Policy, and to any additional terms presented at the time of a specific purchase or program. If you do not agree, do not use the site or place an order.

## 2. Eligibility and Accounts
**2.1 Age.** You must be at least 18 years old, or have the consent of a parent or legal guardian, to place an order or create an account.
**2.2 Account information.** If you create an account, you agree to provide accurate, current, and complete information and to keep it up to date. Accounts are for individual use.
**2.3 Account security.** You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly if you believe your account has been accessed without authorization.
**2.4 One account per customer.** Creating multiple accounts to circumvent purchase limits, pricing, or program eligibility is prohibited and may result in cancellation of orders and closure of all associated accounts.

## 3. Product Information and Images
**3.1 Accuracy.** We work to describe our products accurately and to keep listings current. We do not warrant that product descriptions, specifications, availability, pricing, cover art, or other content on the site are accurate, complete, current, or error-free.
**3.2 Cover images.** Listing images are frequently supplied by publishers and distributors and are often solicitation or promotional art. Final printed covers, trade dress, logos, and cover dates may differ from the image shown. Where a title has multiple covers, you receive the specific cover identified in the listing title identified by barcode.
**3.3 Corrections.** We may correct errors, inaccuracies, or omissions and may update or change information at any time without prior notice, including after you have submitted an order. See Section 4.3.

## 4. Ordering and Payments
**4.1 Order confirmation. When you place an order you'll receive a confirmation email. That email confirms we received your order — it isn't acceptance of it. We accept your order when we ship it, or when we tell you it's ready for pickup. Before then we may need to cancel or adjust an order
**4.2 Payment and information.** By placing an order, you confirm that you are authorized to use the payment method provided, that the billing details match that payment method, and that all information you provide is accurate and complete. Payment is captured at the time you place your order, except for advance orders, which are handled under Section 6.
**4.3 Errors in listings.** Listings may occasionally contain errors in price, description, availability, cover, edition, or image. We may correct any such error and cancel any affected order, including after the order has been confirmed and paid. Incorrectly priced items will not be honored at the listed price.
**4.4 Refusing or cancelling an order.** We may refuse or cancel any order at our discretion, including where we identify or suspect: unavailable stock; fraudulent, unauthorized, or disputed payment; automated ordering, reseller, or scalping activity; inconsistent billing, shipping, or account details; incomplete or implausible names or addresses; or any breach of these Terms.
**4.5 If we cancel.** Where we cancel an order you have already paid for, we refund the full amount for the cancelled items to the original payment method. We are not liable for any other loss arising from a refused or cancelled order.
**4.6 Taxes.** Prices are shown exclusive of applicable sales tax, which is calculated and added at checkout where required.

## 5. Purchase Limits and Anti-Reseller Measures
**5.1 Limits.** We may limit quantities per item, per customer, per household, per account, or per address at any time and without notice, and may cancel or reduce orders that exceed those limits. Unless a listing states otherwise, the standard limit is **two (2) units per item per customer**.
**5.2 Requests above the limit.** Requests for a larger quantity must be made by contacting us directly and are approved or declined at our sole discretion.
**5.3 Circumvention.** Separate or duplicate orders that appear intended to bypass a limit may be combined, reduced, or cancelled. This includes orders placed across multiple accounts, names, payment methods, or shipping addresses associated with the same customer.
**5.4 Purpose.** These limits exist so that individual collectors and readers have fair access to limited titles, and to prevent automated bulk purchasing and reselling.

## 6. Advance Orders (Reservations)
Stuff Your Mom Hates operates an advance-order, or reservation, program for comics and related items that have not yet been printed or released. These terms apply to advance orders in addition to the rest of these Terms.
**6.1 Nature of a reservation.** An advance order is a request that Stuff Your Mom Hates order with an item specifically for you. It is not a completed sale, and it does not guarantee that a copy will be obtained or delivered.
**6.2 No charge at the time of reservation.** Advance orders are not charged when placed. An invoice is issued when the reserved items are inbound to the shop, typically about one week before they arrive. Items ship after the invoice is paid in full.
**6.3 Deposits.** Items priced $50.00 or more require a 50% deposit at the time of reservation. Reservations of ten (10) or more units require a one-time $25.00 deposit. Deposits are held against the resulting invoice, are not store credit, and are applied to the amount owed at invoicing. Deposits are refunded if the reservation is cancelled before its final order cutoff, or if we are unable to fulfill it. Once an item has passed its final order cutoff, the order is committed to the distributor and the deposit is no longer refundable; it remains applied to your invoice.
**6.4 Cancellation by the customer.** A reservation may be cancelled or modified until 9:00 PM ET on the night before that item's final order cutoff (FOC) date, as shown on your pull list. After that time the order has been committed to the distributor and can no longer be cancelled or changed.
**6.5 Declining or cancelling by Stuff Your Mom Hates.** We reserve the right and ability to decline, reduce, or cancel any advance order at any time, for circumstances both foreseen and unforeseen, including but not limited to: insufficient total orders on a title for us to meet a distributor's minimum order quantity; publisher allocation, short-shipping, or cancellation of a print run; non-delivery by a distributor; suspected reseller, scalper, or automated purchasing activity; and pricing or system errors. Where we are unable or unwilling to fulfill a reservation, any deposit held against it is refunded in full.
**6.6 Publisher schedules.** Release dates and expected arrival dates are supplied by publishers and distributors and are subject to change without notice. We are not responsible for publisher delays, allocations, cancellations, or print-run changes.
**6.7 Final sale.** Advance orders are final sale and are not eligible for return under our Return Policy, except where an item arrives damaged and the damage is reported in accordance with that policy.
**6.8 Eligibility.** Advance ordering becomes available to a customer after their first completed purchase has been successfully delivered.
**6.9 Shipping.** Orders containing advance-ordered items ship complete once all items have been received, unless you request an invoice for in-stock items earlier. Shipping is charged on every separate shipment.
**6.10 Purchase limits.** The purchase limits in Section 5 apply to advance orders.

## 7. New Comic Condition and Grading
**7.1 Expected condition.** Newly released comics often arrive with minor manufacturing or handling imperfections that place them below Near Mint, even when they are fresh from the distributor and carefully handled by our team. Unless a listing states otherwise, comics listed as "New" are expected to fall within the **Near Mint to Fine (NM–FN)** range, which is the condition range publishers and distributors consider undamaged and sellable.
**7.2 No grading guarantee.** Stuff Your Mom Hates does not guarantee any specific comic book grade and does not subscribe to or operate under the standards of the comic grading industry, including third-party grading services. All books are sold as collectible reading copies, not as certified investment-grade items.
**7.3 Print-run defects.** Occasionally an entire print run is affected by a widespread printing or production defect. Where that happens, most copies of that title — ours included — are likely to fall in the **Very Fine to Fine (VF–FN)** range.
**7.4 What we receive is what we sell.** As a retailer, we sell the comics we receive from publishers, distributors, and third parties. Distributor standards for "damage" are considerably lower than the expectations of collectors seeking strictly Near Mint or better copies.
**7.5 Common imperfections.** Factors that may reduce a book's grade below Near Mint include minor spine ticks, edge wear, corner blunting, denting, and cover dimpling. Many modern comics — particularly some Marvel titles — use lightweight cover stock similar to interior pages, which makes them more susceptible to these imperfections during printing, binding, and distribution.
**7.6 Acknowledgment.** By purchasing new comics from Stuff Your Mom Hates, you acknowledge and accept these industry realities and understand that no grading guarantees are implied or provided.

## 8. Shipping and Delivery
**8.1 Shipping Policy.** Delivery times, shipping costs, carriers, and related details are set out in our Shipping Policy, which forms part of these Terms.
**8.2 Estimates.** Delivery timeframes are estimates, not guarantees. We are not responsible for carrier delays once a package has left our possession.
**8.3 Risk and title.** Risk of loss and title pass to you upon delivery to the carrier.
**8.4 Address accuracy.** You are responsible for providing a complete and accurate shipping address. We are not responsible for packages delivered to an address you supplied incorrectly, and reshipment may incur additional charges.

## 9. Returns and Refunds
Returns and refunds are governed by our Return Policy, which forms part of these Terms. By making a purchase you agree to it. Note that advance orders are final sale under Section 6.7.

## 10. Acceptable Use
You agree not to:
- use bots, scripts, scrapers, automated checkout tools, or any other automated means to browse, monitor, or purchase from the site;
- purchase for the purpose of unauthorized commercial resale;
- circumvent or attempt to circumvent purchase limits, account restrictions, or security measures;
- interfere with or disrupt the site, its servers, or its networks;
- attempt to gain unauthorized access to any part of the site, other accounts, or connected systems;
- copy, reproduce, or republish site content except as permitted in Section 11;
- submit false, misleading, or fraudulent information; or
- use the site for any unlawful purpose or in violation of these Terms.
We may investigate suspected violations and take any action we consider appropriate, including cancelling orders, suspending or closing accounts, and reporting activity to law enforcement.

## 11. Intellectual Property
**11.1 Our content.** The Stuff Your Mom Hates name, logo, site design, original text, graphics, photography, and software are the property of SYMH and are protected by copyright, trademark, and other intellectual property laws. You may not use them without our prior written permission.
**11.2 Third-party rights.** Comic book characters, titles, logos, cover art, and related trade dress are the property of their respective publishers and rights holders. Nothing on this site grants you any right in that material, and nothing here should be read as a claim of ownership over it by SYMH. Product images and descriptions may be supplied by publishers and distributors and are used for the purpose of identifying and selling the products offered.
**11.3 Your content.** If you submit reviews, comments, images, or other material to the site, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and reproduce that material in connection with operating and promoting our business. You confirm you have the right to submit it. We may remove any submitted content at our discretion.

## 12. Disclaimer of Warranties
The site and all products and services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, to the fullest extent permitted by law. We do not warrant that the site will be uninterrupted, secure, or error-free. Nothing in these Terms limits any warranty or right that cannot be limited under applicable law.

## 13. Limitation of Liability
To the fullest extent permitted by law, SYMH and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or related to your use of the site or our products or services, whether based in contract, tort, or any other legal theory, and whether or not we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total liability for any claim arising out of or related to these Terms, the site, or any product or service will not exceed the amount you paid to us for the product or service giving rise to the claim.
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

## 14. Indemnification
You agree to indemnify and hold harmless SYMH and its owners, employees, and agents from any claim, demand, loss, liability, or expense, including reasonable legal fees, arising out of your breach of these Terms, your misuse of the site, or your violation of any law or the rights of a third party.

## 15. Privacy
Your use of the site is governed by our Privacy Policy, which explains what information we collect and how we use it. By using our services you consent to the practices described in that policy.

## 16. Suspension and Termination
We may suspend or terminate your account and your access to the site at any time, with or without notice, including for violation of these Terms or suspected fraudulent, automated, or reseller activity. On termination, any pending orders and reservations may be cancelled; deposits are handled under Section 6.3 and 6.5. Sections that by their nature should survive termination — including Sections 11 through 14 and 17 — will survive.

## 17. Governing Law and Disputes
These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms, the site, or any purchase will be brought exclusively in the state or federal courts located in Manatee County, Florida, and you consent to the jurisdiction of those courts. Nothing in this section limits any right you may have to bring a claim in small claims court.

## 18. Changes to These Terms
We may update or modify these Terms at any time. The current version is always posted on this page with its effective date. Changes apply to orders placed after the change is posted; your continued use of the site after that point constitutes acceptance. The version of these Terms in effect at the time you place an order governs that order.

## 19. General
**19.1 Entire agreement.** These Terms, together with our Privacy Policy, Shipping Policy, and Return Policy, are the entire agreement between you and SYMH regarding the site and your purchases.
**19.2 Severability.** If any provision is found unenforceable, the remaining provisions remain in full effect.
**19.3 No waiver.** Our failure to enforce any provision is not a waiver of our right to enforce it later.
**19.4 Assignment.** You may not assign your rights under these Terms without our written consent. We may assign ours in connection with a sale or transfer of the business.
**19.5 Events beyond our control.** We are not liable for any failure or delay caused by events beyond our reasonable control, including publisher or distributor failures, carrier disruptions, natural events, utility or network outages, labor disputes, or government action.
